The NUM welcomes CCMA ruling against Fraser Alexander

The National Union of Mineworkers (NUM) is pleased to announce it has won an important case at the CCMA after Fraser Alexander (Pty) Ltd made unilateral changes to terms and conditions of employment last year. The company was found guilty of unlawfully transferring NUM members from the Bridging Provident Fund to the NMG Bridging fund last year. 

The NUM is happy that the CCMA has ruled in favour of the workers. The CCMA  ruled that all NUM members irrespective of which area Fraser Alexander (Pty) Ltd operations must be transferred back to the Bridging Provident Fund not later than 31 May 2017.

The CCMA also ruled that the employer and employee contributions will be transferred in accordance with Section 14 of the Pensions Fund Act to the Bridging Provident Fund.

The CCMA further ruled that the NUM and Fraser Alexander must fast track the outstanding Section 14 process and will make a joint representation to the Financial Services Board to make sure that the matter is not unduly delayed.

We hope Fraser Alexander (Pty) Ltd will respect the CCMA and the due processes of the law in this country. No one is above the law.
